Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of getting parts of their body caught between fixed structures and a dock leveling device: Location: 701 Zerega Ave Bronx, NY 10473 On or about 10/5/10, a) A dock leveling device's side guards did not extend the full operating range of its platform travel. Among other methods, one feasible and acceptable abatement method to correct the hazard is to follow ANSI Standard MH30.1-2000 section 4.3.2 which states "A smooth-faced toe guard shall be provided on the sides of the dock leveling device through the full recess length for the full operating range of platform travel. A toe guard shall also be provided for the rear edge of the dock leveling device if the edge is vertically movable. The guards shall be rigid enough to restrict placement of a foot under the platform. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
