Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by vehicles traveling southbound on the highway. Location: Southbound Bronx River Parkway near exit 8W-E On or about 8/3/10, a) There was no workzone set up to protect workers working right next to the shoulder of the southbound Bronx River Parkway. Employees were performing surveying work. One feasible and acceptable method, among others, to correct this hazard is to follow: DOT/FHWA Part VI of the Manual on Uniform Traffic Control Devices (MUTCD): "Standards and Guides for Traffic Controls for Street and Highway Construction, Maintenance, Utility, and Incident Management Operations," 1988 edition, Revision 3, September 3, 1993. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
