Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of chlorine gas: a)Chemical Control Cage: On or about 11/17/09; incompatible chemicals were stored together, creating the potential for the generation of chlorine gas. Four 55-gallon drums of Divosan Plus (oxidizer) were stored next to four 55-gallon drums of Dibac Liquid Chlorinated Sanitizer (sodium hypochlorite). b)Chemical Control Cage: On or about 11/17/09; incompatible chemicals were stored together, creating the potential for the generation of chlorine gas. One 55-gallon drum of Acifoam LP Acidic Foam Cleaner (acid) was stored with one 55-gallon drum of Dibac Liquid Chlorinated Sanitizer (sodium hypochlorite) on the same pallet. Additionally, four 55-gallon drums of Hypofoam Highly Chlorinated Foam Cleaner (sodium hypochlorite) were stored above this pallet. c)Chemical Control Cage: On or about 2/11/10; incompatible chemicals were stored together, creating the potential for the generation of chlorine gas. Four 55-gallon drums of Hypofoam Highly Chlorinated Cleaner (sodium hypochlorite) were stored above four 55-gallon containers of Acifoam LP Acidic Foam Cleaner (sulfuric acid and phosphoric acid) and one 55-gallon drum of Divosan Plus (oxidizer). d)Chemical Control Cage: On or about 2/11/10; incompatible chemicals were stored together, creating the potential for the generation of chlorine gas. Three 55-gallon drums of Divosan Plus (oxidizer) were stored above a 55 gallon container of Dibac (sodium hypochlorite). e)Chemical Control Cage: On or about 2/11/10; incompatible chemicals were stored together, creating the potential for the generation of chlorine gas. An open container of Divosan Plus (oxidizer) was stored and being used near a 330-gallon tote tank of Easy Foam (sodium hypochlorite). NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19. Among other feasible methods the following methods of abatement would eliminate the hazard identified: 1.Physically separate incompatible chemicals and store them in separate storage areas.
