Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) 1 Barker Ave White Plains, NY (Parking Lot Corner): An employee was exposed to a Twelve-foot fall hazard while he was engaged in a tree trimming operation. This condition occurred on or about 8/21/09. One feasible and acceptable method of abatement is to follow guidance set forth in ANSI Z133.1 for Arboricultural Operations-Pruning,Repairing,Maintaining, and Removing trees, and Cutting Brush-Safety Requirements. NOTE: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
