Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling while climbing trees: Location: 12 Muir Place New Rochelle NY 10801 On or about 8/17/09, a) An employee fell approximately 11 feet 4 inches while ascending a tree. One feasible and acceptable abatement method, among others, to correct this hazard is for the employer to follow American National Standards Institute (ANSI) Z133.1-2006, Safety Requirements for Arboricultural Operations, section 8.1.19 which states "The arborist shall be secured while ascending the tree. The arborist shall be tied in once the work begins and shall be tied in until the work is completed and he or she has returned to the ground. The arborist shall be secured when repositioning the climbing line." NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
