Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being caught in an elevator fall: Location: 363 Huguenot St New Rochelle NY 10801 On or about 7/16/09, a) A freight elevator ran down hard into the pit springs with 6 workers on it when it was overloaded. The load capacity plate was painted over. Among other methods, feasible and acceptable means of abatement would be to have a readily legible capacity plate as required by ASME A 17.3-1993 Safety Code for Existing Elevators and Escalators section 3.7.4 (b) and to train employees to recognize and determine loads being placed on elevators to ensure the elevator's capacity is not exceeded. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
