Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)The employer does not provide adequate fall protection to employees performing tank washing activities on tank trailers. This was observed on July 14, 2009, and thereafter, in that the personal fall arrest system, which included a horizontal lifeline and retractable lanyard installed in wash bays 3 and 5 had not been designed, installed and maintained as required. The conditions observed included but were not limited to: 1)In tank wash bay 3 the clevis used as an anchorage connector for the DBI SALA self retracting lanyard was not designed for that purpose, and was not marked with its rated load limit. 2)In tank wash bay 5 two of three wire rope clips used on the horizontal lifeline were installed backwards. 3)In tank wash bay 5, the retractable lanyard was not removed from service after exposure to a flash fire in that bay on July 7, 2009. 4)In tank wash bay 3, the self closing hook on the DBI Sala self retracting lanyard with winch did not lock closed due to contamination. One feasible and acceptable method of abatement to correct this hazard would be to install a personal fall arrest system, horizontal lifeline and retractable lanyard designed by a qualified person, installed in accordance with the manufacturer's instructions, inspected and maintained in accordance with manufacturer's requirements. Pursuant to 29 C.F.R 1903.19, within ten (10) calendar days from the abatement date for this citation, the employer must submit documentation showing that it is in compliance with the standard, describing the engineered lifeline, personal fall arrest systems and components, and implementation of a program to insure the continued adequacy of all parts of the fall protection systems.
