Nevada Revised Statute 618.375(1): Every employer shall furnish employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees: The employer failed to ensure aerial lift operators properly entered the platform, as follows: a)At the Loft Works At Tenaya construction site, Building A, canopy installation activities, an employee was exposed to a falling hazard of 35 feet while entering the basket of an aerial lift platform (make: Genie, model no: S-40, serial no: S4007-14036) by climbing over the guardrail system. Reference: Operators Manual for Genie S-40, Safety Rules, Page 4, Paragraph 2. Paragraph 2: Do not sit, stand or climb on the platform guard rails. One feasible means of abatement would be to follow the operating instructions and safety rules provided in the operators manual.
