Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by flying parts expelled from the machine or being caught in the rotating parts during the operating cycle: (a) For the employees operating the Mori Seiki Numerical Control lathe, Model SL- 25B5, Serial #2969, without a functioning door interlock device, in the machine shop of Sheyenne Tooling & Manufacturing, located at 701 Lenham Avenue SW, Cooperstown, North Dakota. (b) For the employees operating the Mori Seiki Numerical Control lathe, Model SL- 25B5, Serial #5106, without a functioning door interlock device, in the machine shop of Sheyenne Tooling & Manufacturing, located at 701 Lenham Avenue SW, Cooperstown, North Dakota. (c) For the employees operating the Mori Seiki CNC lathe, Model HT-20, Serial #HT22218SC, with the door interlock device bypassed, in the machine shop of Sheyenne Tooling & Manufacturing, located at 701 Lenham Avenue SW, Cooperstown, North Dakota. (d) For the employees operating the Shizuoka CNC vertical mill, with the door interlock device bypassed, in the machine shop of Sheyenne Tooling & Manufacturing, located at 701 Lenham Avenue SW, Cooperstown, North Dakota. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the requirements of ANSI B11.22-2002, American National Standards Institute - Safety Requirements for Turning Centers and Automatic, Numerically Controlled Turning Machines which includes, among other requirements, the following: 1. Paragraph 6.21: Machines shall be safeguarded whenever practicable by fixed or interlocked moveable guards. 2. Paragraph 6.21.1.1: Measures to minimize possible defeat of interlocking shall be taken. 3. Paragraph 6.21.1.2: Machine operation shall only be possible when the guards are closed and the safeguarding (protective) devices are active. If it is possible, in this mode, to open an interlocked moveable guard, the hazardous movements shall cease and be inhibited.
