Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being run over by a refuse truck: a)Milburn Avenue and Fern Avenue, Lyndhurst, NJ: The lifter attempted to get on the riding step while the driver was backing up the vehicle and the lifter fell off the riding step, on or about 04/17/2009. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to train operators and employees to ensure that no persons ride on the riding step when the vehicle is backing up as described in ANSI Z245.1-1992 Section 6.2.4 (Vehicles Equipped with Riding Steps). b)Milburn Avenue and Fern Avenue, Lyndhurst, NJ: The automatic transmission on Truck #146 was not equipped with a neutral position interlock, on or about 04/17/2009. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to equip the vehicle with a neutral position interlock that will prevent the throttle from automatically advancing when the compacting or other auxiliary equipment is operated as described in ANSI Z245.1-1992 Section 7.1.3 (Automatic Neutral Interlock). c)Milburn Avenue and Fern Avenue, Lyndhurst, NJ: The packer panel controls on Truck #146 were not labeled as to their function, on or about 04/17/2009. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard to equip the controls with labels that indicate their function as described in ANSI Z245.1-1992 Section 7.1.4 (Controls). d)Milburn Avenue and Fern Avenue, Lyndhurst, NJ: Truck #146 did not have caution signs affixed to the sides of the vehicle above the riding steps and at the driver's station, such as "CAUTION - DO NOT USE RIDING STEPS WHEN THE VEHICLE IS EXCEEDING 10 MPH OR OPERATING IN REVERSE OR WHEN DISTANCE TRAVELLED EXCEEDS 2/10 MILE", on or about 04/17/2009. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to equip the vehicle with caution signs above the riding steps and at the driver's station stating "CAUTION - DO NOT USE RIDING STEPS WHEN THE VEHICLE IS EXCEEDING 10 MPH OR OPERATING IN REVERSE OR WHEN DISTANCE TRAVELLED EXCEEDS 2/10 MILE" as described in ANSI Z245.1-1992 Section 7.1.12.6 (Safety Signs).
