Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard: On or about 11/18/09, at the PSEG site, employees were working on a turbine generator. This generator had a ongoing static pressure test in progress. The employees of Sulzer was unaware of the test in progress and remove a access door. This door was pressurize and blew off, injuring two employees. Among other methods, one feasible and acceptable abatement method to correct this hazard is to inform all employees working near or on the generator of the ongoing test. The employer failed to inform the employees of the test, any hazards associated with the test and precautions that needed to be taken during the test.g
