Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by or crushed by the wheel of a wheeled loader. a) On or about 06/17/09, at the maintenance shop, two employees (head mechanic and helper) were working on wheel loader. The head mechanic was trouble shooting a drive train issue with the wheel loader. The head mechanic was working underneath the un-chocked wheel loader when the tractor lunged forward. Among other methods, one feasible and acceptable abatement method to correct the hazard would be to chock, restrain or block, the tires of the vehicle, thereby limiting the vehicles movement.
