Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falls while being lifted on an elevated work platform: (a)On or about 07/15/09 at the construction site located at 2218 Hwy. 281 N., Blanco, Tx, where employee were working from a work platform, extended by a JGL/Graddall G9-43A all terrain lift, which did not meet the design and use requirements of ANSI/ITSDF B56.6-2005, Section 8.24.1(b): having a width greater than the overall width of the truck [measured across the load bearing tires plus 10 in. (250 mm) on either side]. and Section 8.24.1(h): not having a means to securely attach the platform to the lifting mechanism to prevent the platform from inadvertent pivoting. "Among other methods, feasible and acceptable abatement methods to correct this hazards are to use a safer alternate method such as the use of a platform approved by the manufacturer meeting the requirements of ANSI/ITSDF B56.6-2005 for the attachments on rough terrain lifts and ensure appropriate size for the working platform.te
