Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees could be exposed to flying metal fragments should a high pressure receiver tank fail: a) for the ammonia piping system and high pressure receiver tank (TF3-R4) at the Essence Tank Farm, as observed on or about January 23, 2009. There was significant corrosion at the west end of the high pressure vessel where the piping entered. Abatement Note(s): One feasible and acceptable means of abatement is to ensure high pressure vessels with corrosion are inspected, tested and repaired/replaced if necessary. Non-destructive test methods are available which can determine metal thickness before it becomes an issue.
