Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees a place of employment which is free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees are exposed to the hazard of being struck-by falling debris from the structure being demolished. This violation was most recently observed at the employer's worksite located at 18511 Beaumont Highway TX, 77049 on or about January 16, 2009, and times prior thereto, where employees, utilize insufficient equipment to demolish a structure, in that the Hitachi EX1200 has a maximum reach of only 56 feet 11 inches for demolishing a structure that is 94 feet tall. Among other methods, one feasible and acceptable method to correct this hazard is to use a crane or backhoe that has the capability of reaching 5 feet above of the top of the structure being demolished in accordance with ANSI/ASSE A10.6 Section 14.3 - 2006. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that operators only use cranes and backhoes that reach at least 5 feet above the structure being demolished. The violation must be abated no later than 20 days from the receipt of this citation. Disclaimers: 1. You are not limited to the abatement methods suggested above. 2.
