Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation hazards: Employees operating the Verson, 60 ton mechanical press brake, serial #19925-208-60, were exposed to amputation hazards for the following instances: a)Employees operating the Verson, 60 ton mechanical press brake (B6), serial #19925-208-60, were exposed to amputation hazards in that periodic and regular inspections of mechanical press brake components such as, but not limited to, clutches and friction brakes was not performed or documented. Among other methods, one feasible and acceptable method to correct this hazard is to establish and follow a program of periodic regular inspections of the press brake to ensure that all of the parts, auxiliary equipment and safeguards are in safe operating condition and adjustment. The user shall maintain records of these inspections and the maintenance work performed as referenced in paragraph 9.3.1 of ANSI B11.3, Safety Requirements for Power Press Brakes, February 14, 2002 edition. b)Employees operating the Verson, 60 ton mechanical press brake (B6), serial #19925-208-60, were exposed to amputation hazards in that operators, set-up, maintenance and supervisory employees were not trained in safe working procedures as required by their job tasks as they relate to machine guarding. Among other methods, one feasible and acceptable method to correct this hazard is to establish a training program that "shall ensure that individuals associated with press brake production systems are properly trained in safe working procedures and are qualified to perform the functions to which they were assigned" as referenced in Paragraph 9.2.3 of ANSI B11.3, Safety Requirements for Power Press Brakes, February 14, 2002 edition. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is completed.
