Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an uncontrollable falling load: (a) Facility, New Castle Road, Butler, PA: On or about February 3, 2010, the brakes were not functional on the bridge of the #1 five ton hoist located at the garage door end. The hoist continues to travel when the forward button is released. Among other methods, one feasible and acceptable means of abatement for this violation is to ensure that the bridge brake is in a proper working condition as referenced by the American Society of Mechanical Engineers, ASME B30.11, Section 11-1.8.4(d).le
