Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee in that employees were exposed to: a. At the dock in building 850/Gateway Warehouse On March 26, 2009, an employee operating a Caterpillar, model C-5000-LPS, #31 forklift truck equipped with operator restraint systems (seatbelts), was not required to utilize restraints when moving loads. b. In building 850/Gateway Warehouse On March 26, 2009, another employee operating a Caterpillar, model C-5000-LPS, #29 forklift truck equipped with operator restraint systems (seatbelts), was not required to utilize restraints when moving loads. Among other methods, one feasible and acceptable abatement mmethod to correct the hazard is to ensure operators wear restraint systems while operating forklift trucks as stated in the American Society of Mechanical Engineers standard for Low Lift and High Lift Trucks, ASME B56.1-2000, section 5.3.19.
