Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Falls to the lower level while elevated by an All-Terrain Forklift. (a) American Metals Inc., 1941 Phinizy Road, Augusta, Georgia 30906: On or about August 4, 2009 an employee was observed working in the basket elevated by the All-Terrain Forklift. No one was at the controls or within 25 feet of the vehicle at the time the employee was elevated. The employer did not comply with the specification outlined in ASME B56.6-1992, Section 5-15(s), Elevating Personnel. No abatement certification or documentation is required for this item.
