Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught by and struck by hazards: On or about 07/14/09 at Gordon, GA: Employees were exposed to caught between and struck by hazards, while performing switchman duties on the company's rail spur. The employer failed to ensure that railcar switching operations were performed safely. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THESE HAZARDS IS: 1) The company should re-assess its current policies and procedures pertaining to the safe movement of railcars within its company spur. The employer should conduct retraining for employees, who are not meeting safety standards, and review its disciplinary policies to ensure the enforcement of work rules. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
