Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about Friday April 17, 2009 at the 2406 Tech Center Parkway, Suite 200 Lawrenceville, Georgia 30043 location an employee operating an Eagle 2-42 Trailer Aerial Lift fell to his death because the employer failed to repair and maintain warning and safety devices installed by the manufacturer. Among other methods, feasible and acceptable methods to correct the hazard are: a. to follow the requirements in Sections 8.1 through 9.5 of the American National Standard Institute, Inc. (ANS/SIA) A92.2-1990, American National Standard Vehicle-Mounted Elevating and Rotating Aerial Devices which addresses inspection and testing requirements and the owners/operators manual for the Eagle 2-42 Trailer Lifts recommended maintenance and inspection schedule. b. to provide the trainer and operators a copy of the owner/operators manual from the manufacturer. No abatement certification or documentation is required for this item. The employer provided documentation that indicated the Eagle 2-42 Truck Aerial Lift was removed from service.
