Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:07/10/08 Condition:Employees were exposed to electrocution or electrical shock hazards since users were not trained by a diving agency and certified in open water, the Brownie's Third Lung compressor was not secured to prevent it from falling into the pool, performed diving work alone, and a 16 gauge electrical cord was used rather than the required minimum 14-gauge cord. Among other methods, one feasible and acceptable abatement method to correct the hazard is to assure that users are certified as divers in open water, secure all electrical equipment to prevent their inadvertent entry into the pool, dive with a coworker, and to use an extension cord not less than 14 gauge, all which is located and required by the manufacturer's manual. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
