Labor and Employment Article, Section 5-104(a), Annotated Code of Maryland: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:09/03/08 Location:Junction House 3 Condition:Employees worked on a steeply sloped deflection plate, removing accumulated spilled ore that was subject to dislodgement, which exposed employees to being struck and crushed by pieces of aggregated ore. Among other methods, one feasible and acceptable means of abatement to correct this hazard is to prohibit employees from accessing and working from or below the deflection plate during the cleaning process and to always use power washers from the above platforms to clean the deflection plate.
