Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards associated with hoisted loads: For the Assembly Shop hoisting equipment: On or about January 21, 2009, the employer failed to ensure proper maintenance and hoisting procedures were followed by employees using a two (2) ton budgit man guard electric hoist. A load was elevated approximately seven (7) feet high and struck two employees when it fell from the hoist. The employer failed to ensure safe work practices, such as the following, were implemented: remaining clear of suspended loads, centering the load under the hoist, inspecting the hook for defects, picking loads in excess of rated capacities, and abiding by all warnings. Feasible abatement methods for this violation include, but may not be limited to, operating, maintaining and inspecting the hoisting equipment in accordance with ASME/ANSI B30.16 Overhead Hoists (Underhung) and the hoist manufacturer's instructions.
