Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY: Should the hoist fail allowing the load to fall and strike and employee. a)At the facility, on or about 06/24/09: Three underhung overhead hoists were being operated without having received a periodic inspection in more than twelve months. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: Ensure all underhung overhead hoists receive frequent and periodic inspections as required by the manufacturer and the American Society of Mechanical Engineers (ASME B30.16-1993) document, paragraph 16- 2.1.1(b)(2) which states; visual inspection by a designated person who makes records of external conditions to provide the basis for continuing evaluation. An external coded mark on the hoist is an acceptable identification in lieu of records. (a) normal service - yearly. Abatement certification must be submitted for this item.
