Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF FALLING OR BEING STRUCK-BY : a)Zimowski Food Specialties Inc., Building 4, on or about 10/9/08. The employer failed to have the freight elevator inspected, tested and maintained in accordance with NYSDOL Industrial Code 8 - Construction, Guarding, Equipment, Maintenance and Operation of Elevators, Dumbwaiters, Escalators, Hoists and Hoistways in Factories and Mercantile Establishments. b)Zimowski Food Specialties Inc., Building 4, on or about 10/09/08: Freight elevator gate was not provided with an interlock or electric contact to prevent operation of the elevator with the gate open. Abatement certification must be submitted for this item. Among other methods, one feasible and acceptable abatement method to correct these hazards is to contract for an authorized agent to perform periodic inspections of the freight elevator every six months in accordance with paragraph 8-1.7 of NYSDOL Industrial Code 8. Provide an interlock or electric contact at the gate to prevent operation of the elevator with the gate open in accordance with paragraph 8-1.21(c)(2) of NYSDOL Industrial Code 8.
