Text For Citation: 01 Item/Group: 001 Hazard: CAUGHT

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about October 8, 2008 with respect to the jobsite located at 1730 S Hazel in Pine Bluff, Arkansas where employees were engaged in masonry activities at the new addition to the South East Arkansas University complex. Employees were operating a Lull - JLG Model 944E42 RTFL rough terrain forklift. The employees were not wearing the seat belts provided by the manufacturer, a condition that exposed the employees to the hazards of being caught in during a roll over. One feasible and acceptable abatement method, among others, is to have operators fasten the seat belt while operating equipment. (Reference: ASME B56.6-2002 Paragraph 6.2.1 Before starting to operate the rough terrain forklift truck: (a) be in the operating position and fasten the seat belt, if so equipped.)
