Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to stuck-by or crushed by hazards: On or about 06/29/2010 at New Penn Motor Express Inc., 3110 Plainfield Pike, Cranston, RI employees were operating the forklift trucks without using the provided seatbelts. Among other methods, one feasible and acceptable method to correct this hazard would be to ensure that all forklift operators utilize the restraint devices provided on the forklift as stated in ASME B56.1-1993 Safety Standard for Low lift and High Lift Trucks, section 7.39, Operator Restraint Systems. "Abatement documentation is required per 29 CFR 1903.19, in the form of written (i.e. policies, procedures, photos and/or invoices) or other evidence that this item has been corrected."
