Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries while using a below-the-hook lifting device which was not designed by a registered professional engineer or other qualified person: a.Bar Soap Room, 5th Floor, Building #9: On or about June 7, 2010, an employee sustained injuries to both legs while unloading finished soap from a soap frame that fell and pinned him to the floor when the below-the-hook lifting device failed. Among other methods, the following are feasible and acceptable abatement methods to correct the hazards: Comply with ASME B30.20-2006, Below-the-Hook Lifting Devices, Chapter 20-1 as far as ensuring the operators are trained and the device be marked, designed, constructed by a qualified person, inspected, load tested and maintained. a.Operation - Chapter 20-1.4.2: instruction on use, information on the load, not exceed the rated load for the device, proper attachment and demonstrated ability to operate lifting device. b.Marking - Chapter 20-1.2.1: marking on the lifting device with load rating. c.Construction - Chapter 20-1.2.2: designed and constructed by a qualified person. d.Inspection - Chapter 20-1.3: inspection initially, every lift inspection, periodic inspection according to Table 1 with records. e.Load Testing - Chapter 20-1.3.8.2; load test initially and if alterations, repairs or modifications occur. f.Maintenance - Chapter 20-1.3.9: maintenance program designed by qualified person to repair, maintain or modify lift with records.
