Text For Citation: 01 Item/Group: 001 Hazard: CUTS
Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer did not ensure the place of employment was free from recognized hazards, as follows: a) On May 19, 2008 at Union Park, manhole/pipe installation was taking place on Discovery Two Drive. An employee sustained fatal injuries while cutting a 36 inch reinforced concrete pipe. The employee had cut 2 feet of the bell end of the reinforced concrete pipe with a Stihl TS400 Cutquick gas-powered saw. The employee had suffered severe head trauma while he attempted to crawl out of the unsecured pipe, which broke off, fell approximately 9 to 12 inches to the ground, and tipped over, causing fatal injuries. Because the bell end of the reinforced concrete pipe had not been secured while it was being cut, the pipe fell on the employee. A feasible means of abatement would be to follow the Stihl TS400 Cutquick Operator's Manual, as follows: 1. Page 18, which states "Object to be cut must be fully supported; Must be secured so that it cannot roll or slip away; Must be protected against vibration." 2. Page 20, which states "Pipes and round objects, etc. must be secured so that they cannot roll."
