Text For Citation: 01 Item/Group: 001 Hazard: FALLING
T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On May 15, 2008 the employer did not ensure employees working in the Transfer Building had a safe work environment. Large loads of garbage are dumped on a concrete floor (242 ft. wide by 137 ft. long). After the garbage is sorted, a front-end loader shovels the garbage in chute openings (40 ft. by 7 ft.). Eighteen feet below trailer trucks receive this garbage and haul it off to dump sites. No precautions were taken to prevent garbage from falling on employees working on the lower level. Feasible Abatement for this violation could be, but not limited to: 1.Develop and implement a plan to protect employees from the dangers of falling garbage. a. Install blinking or rotating or pulsating overhead light on both levels to coordinate, notify, and alert employees when it is safe to perform work. b. Train employees on both levels about the Flashing Lights. c. Post signs on each level explaining the purpose of the Flashing Lights. c. Establish a monitoring system on each level by appointing a competent person to recognize the hazards and give warnings to employees unaware or acting in unsafe manners. Note: this competent person should be on the same working surface and in visual sight and close enough to communicate orally with the employees being monitored. The safety monitor should not have other responsibilities which could take the monitor's attention from the monitoring function. d. Use progressive discipline to ensure the rules are followed. 2.Other means of notifying the employees working on both levels is the use of walkie- talkies, radios or TV monitors.
