Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) At Farmers Grain & Co-Op for employees exposed to the potential for injury while operating the manlift created by the lack of inspection of the manlift to ensure that the braking system functioned properly at all times and the manlift could not become stuck between work floors stranding an employee in the manlift. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the requirements of ANSI B17.1 Safety Code for Elevators and Escalators which identifies the requirement for inspection.
