Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to burns: On or about 01/23/2009, at 400 University Drive, in Coral Gables, Florida, a STIHL TS 700 cut-off machine was not operated in a safe manner with the gas cap properly secured. ABATEMENT NOTE: Among other methods, a feasible and acceptable means of abatement is to follow the recommendations of the manufacturer as provided on the warning label and ensure that the fuel cap is securely tightened before use. PLEASE NOTE: DOCUMENTATION AND CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
