Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing injuries: On or about 10/06/2008, At 10943 NW 122nd Street, in Medley, Florida, in the warehouse area, an employee was operating a Clark powered industrial truck without wearing a seat belt. Among other methods, a feasible and acceptable means of abatement is to follow the recommendations of the manufacturer as provided on the warning label that states that the lift truck operator must wear a seat belt during operation. A seat belt assembly needs to be installed as referenced by ASME/ANSI B56.1. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
