Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall, struck-by, and crushing hazards: On or about 5/19/08, at 135 S State Road 7, Royal Palm Beach, an employee was observed riding outside of the cab of a Terex TX5519 lull. Among other feasible and acceptable methods of abatement would have been to restrict employees to riding in the cab of the powered industrial truck.
