Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that the employer did not maintain a guard to protect employees from mechanical hazards of pinch point, nip points and rotating parts: On or about 12/14/07, on the Rochester Gas and Electric Right of Way off from Greenleaf Road in Rochester, New York, 14612; employees were operating an Altec aerial lift Model A77-T that had a partially broken cover in the boom tip area. NO ABATEMENT CERTIFICATION REQUIREDATION
