Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards: On or about March 11, 2010, at a workplace located at Palestine High School, 1600 South Loop 256, Palestine, Texas 75801; The employer by not keeping employees clear of loads being lowered by hydraulic and manually-operated jacks, exposed them to struck-by and crushed-by hazards. AMONG OTHER METHODS, AT LEAST ONE FEASIBLE AND ACCEPTABLE MEANS TO ABATE THESE HAZARDS INCLUDES, BUT IS NOT LIMITED TO: Ensure that employees a kept clear of loads on jacks while lifting and lowering.
