Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about February 23, 2009, at a work site located at 11034 Indian Trail in Dallas, Texas 75229, the employer by not properly maintaining the Payson casters on the wind and dust chamber, exposed employees in and around that area to the hazard of being struck by the chamber. Among other methods, one feasible means of abatement includes but is not limited to: a) Following the manufacturers recommendations on important safety and maintenance which includes but is not limited to: 1. Check the swivel assembly to see if excessive play exists due to wear. If the swivel assembly is loose, it should be replaced. If the caster has a king bolt nut, do not retighten. If it is loose, it is worn and should be scrapped. If the swivel assembly does not turn freely, replace it. If the swivel bracket is bent or distorted, replace immediately. 2. Tighten loose bolts and nuts and look for broken welds. 3. Examine the frame, platform, legs, or equipment from any distortions, bending, or other damage. Discontinue used and replace immediately. 4. Relubricate on a regular schedule according to the environment of the application. 5. Regular lubrication adds to the life and performance of wheel and swivel bearings.
