Text For Citation: 01 Item/Group: 001 Hazard: UNAPOPPROC
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are expose to death or serious injury from an arc flashing. This violation was discovered on or about February 18, 2009, at a workplace located at 19364 Hidden Lake Dr., Tyler, TX 75703 where at least one (1) employee, who opened an energized pad-mounted transformer and was exposed to the hazards of arc flash, did not wear personal protective equipment. AMONG OTHER METHODS, AT LEAST ONE FEASIBLE AND ACCEPTABLE MEANS TO ABATE THIS HAZARD INCLUDES, BUT IS NOT LIMITED TO: Implement the elements required by the National Electric Safety Code for the selection and use of personal protective equipment including but not limited to: face shield, flame-resistant neck protection and clothing of the appropriate arc thermal performance value (ATPV), and rubber insulating gloves. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the requirement, including describing the steps that it is taking to ensure that the appropriate personal protective equipment (i.e. face shield, flame-resistant neck protection and clothing of the appropriate ATPV, and rubber insulating gloves, etc.) is being selected and used.
