Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards associated with operating a hoist with a hook that had a missing safety latch: At the site: The hook on the hoist at Scallop Cooler #3 had a missing safety latch. One feasible and acceptable means, among others, of abatement would be to replace the hook or install a new safety latch. ANSI B30.16-1973 references the requirements for frequent inspections and adjustments and repairs of hooks and safety latches.
