Section 5(a)(1) of the occupational safety and health act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were increasing the height of a scissor lift utilizing a step ladder on the lift platform: Jobsite: Lobby. Workers were exposed to falling approximately 24 feet onto the floor below while servicing the light fixtures where the Upright MX-19 scissor lift was not of sufficient height to reach the work area and a step ladder was used on the platform to increase the working height. One method of abatement, among others, would be to purchase a lift having a greater working height.
