Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: The employer does not inspect and test atmospheric storage tanks every 10 years when no calculated corrosion rate was conducted previously. This violation was most recently observed at the Marathon Petroleum Company in the tank farm area on or about May 20, 2008, and times thereto, where tanks #T-18, T-121, T-124, T-125, T-153, T-164, T-165, T-166, T-517, T-518 containing flammable materials were not inspected accordingly. Among other methods, one feasible and acceptable method to correct this hazard is to perform periodic inspections and tests of atmospheric storage tanks in accordance with American Petroleum Institute Standard (API) 653 Second Edition, December 1995, Tank Inspection, Repair, Alteration, and Reconstruction. Pursuant to 29 CFR 1903.19, within ten (10) calendar days after the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including documentation showing the results of the inspections and tests performed.
