Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The employer does not ensure that operators of Dump Trucks, wear seat belts to prevent them from falling out of or being ejected from their seat. This violation was most recently observed on or about October 17, 2008, at the Waste Management of Texas, Landfill where the employee was operating the dump truck and was exposed to a struck by hazards. One, method among other methods to correct the condition, is to enforce that all operators wear their seat belts in accordance with the Operator's Manual.
