Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to struck by the digger equipment: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a ser golpeados por el equipo "digger": An employee of Jose Lopez Gonzalez dba L&L Construction, company hired by Enrique Alvarado dba Quique's BBQ, operated a digger equipment, trademark Ford, model 555D, to complete the work of laying the concrete to the curb on the private road at the back of Quique's BBQ. The equipment was not in safe conditions for use: brakes pedal and the emergency system were not adjusted, brake bands and front wheels worn out, signal lights and front lights were not working, stops lights were broken, the horn was not working and the seat belt was broken. On November 14, 2008, an employee of Enrique Alvarado dba Quique's BBQ responsible for the construction of the curb, which was accommodating the concrete in the mold of the curb, died when was strucked by the equipment that went off and the operator lost the control of it. One feasible and abatement method among others to correct the hazards can be: 1) Perform visual inspections and operating conditions to the equipment each time it utilized. 2) Provide preventive maintenance to the equipment. 3) Comply with the specifications and manufacturer's recommendations for the use and maintenance of the equipment. 4) Remove the equipment in unsafe conditions and identify it as "out of service". Un empleado de Jose Lopez Gonzalez dba L&L Construction, compania contratada por Enrique Alvarado dba Quique's BBQ operaba el equipo "digger", marca Ford, modelo 555D para completar el trabajo de echar el concreto al encitado en un camino privado, en la parte posterior del establecimiento Quique's BBQ. El equipo no se encontraba en condiciones seguras de uso: pedal de frenos y el sistema de emergencia sin ajuste, bandas y gomas delanteras desgastadas, los focos de las senales y los focos delanteros no funcionaban, los focos traseros estaban rotos, la bocina no funcionaba y el cinturon de seguridad estaba roto. El dia 14 de noviembre de 2008 un empleado de Enrique Alvarado dba Quique's BBQ encargado de los trabajos de construccion del encintado, que se encontraba acomodando el concreto que se echaba en el molde del encintado murio al ser impactado por el equipo "digger" que se apago y el operador perdio el control del mismo. Un metodo viable entre otros metodos que se pueden utilizar para corregir los riesgos existentes es: 1) Realizar inspecciones visuales y operativos del equipo cada vez que se utilice. 2) Dar mantenimiento preventivo al equipo. 3) Cumplir con las especificaciones y recomendaciones del manufacturero en el uso y mantenimiento del equipo. 4) Remover el equipo en condiciones inseguras e identificar que esta fuera de servicio.ar
