Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards at the outside loading docks, trailer storage yard, and general yard areas: (a) JBS dba Swift and Company, 800 North 8th Ave., Greeley, CO 80631: The employer did not provide a workplace that was free from recognized hazards in that employees working at the outside loading docks, trailer storage area, and general yard areas are exposed to vehicular traffic. On December 27, 2008, an employee operating a forklift in the Upper Trim loading dock area, exited the forklift and was struck-by a Kalmar Ottawa Terminal Tractor (SN #319728) with trailer attached that was backing up to the Upper Trim loading dock resulting in a fatality. This condition exposed employees to struck-by hazards including, but not limited to, broken bones, and death. Abatement note: Among other methods, one feasible and acceptable method of abatement would be to incorporate the following: (1) The implementation of a policy that prohibits the loading of trailers and trash removal operations at the same time to minimize pedestrian traffic in the area. (2) The installation of communications (ie radios) between the forklift operators and the Shag drivers. (3) The implementation of a policy that creates restricted areas or zones in the loading dock and trailer yard that only allows authorized personnel (ie persons performing job functions) and prohibits general pedestrian traffic. (4) The creation of designated pedestrian walkways in the trailer storage yard, loading dock areas, and general yard. (6) A change in company policy that requires the Shag drivers to prep the trailer (ie chokes and candlesticks) once it is positioned at the loading dock.
