Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a lack of temporary traffic control devices conspicuously placed to alert, channel and protect against approaching vehicular traffic: a) Construction / Utilities --- Intersection of Roemer Boulevard and Speaman Avenue - Farrell, PA / Traffic Control: On or about August 10, 2011, employees were performing excavation and related waterline work. Excavation was located next to traffic traveling West on Roemer Blvd and the near the intersection of Speaman and Roemer. Road closed signage and/or devices to alert personnel of a road closure were not posted on Speaman for traffic traveling on Speaman toward Roemer. An Personnel were not protected by any additional devices/methods (e.g. Truck Mounted Attenuator). b.) Construction / Utilities --- Intersection of Roemer Boulevard and Speaman Avenue - Farrell, PA / Traffic Control: On or about August 10, 2011, employees were performing excavation and related waterline work. Excavation was located next to traffic traveling West on Roemer Blvd and the near the intersection of Speaman and Roemer. An appropriate taper was not deployed on Roemer Boulevard to direct traffic around the work being conducted with the excavation. The existing taper was not long enough and contained gaps. Personnel were not protected by any additional devices/methods (e.g. Truck Mounted Attenuator). ABATEMENT NOTE: Among other methods, feasible and acceptable means to correct the condition included complying with the applicable guidance noted in the MUTCD and Penn DOT Pub 213.
