Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard from flying shards of PVC plastic: a) for the employees working in areas where compressed air was being distributed by PVC plastic, such as in the Pre-Cut Department, as observed on or about February 27, 2008. The plastic pipe delivered 120psi of compressed air to air nozzles being used to remove onion skins and to clean out the dicing machine.
