Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by/caught in between hazards while unloading pipe material from an 18-wheeler truck, that was not equipped with sidestakes to secure the load. Employees were allowed to load and unload delivery trucks that did not have sidestakes installed on the truckbed to prevent materials falling or rolling off the truckbed. Among other methods, one feasible and acceptable method to correct this hazard is to instruct employees to refuse delivery of trucks not equipped with sidestakes or to require employees to install sidestakes on a truck before unloading.
