Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees are exposed to moving machine parts while operating a foot operated machine without a foot pedal guard: (a)Bindery Department: An instance of this violation was most recently observed on July 31, 2009, where employees were exposed to unintended operation of the ISP Stitching & Bindery products stitcher machine, Model S3A 7/8, S/N 7201, due to an unguarded foot pedal. Among other methods, one feasible and acceptable abatement method is that the employer must guard/protect the foot operated control device to prevent inadvertent operation of the machine due to falling or moving objects making contact with it, or from unintended operation by accidentally stepping onto the foot control. Pursuant to 29 CFR 1903.19(c) and (d), the employer must provide documentation that this specific instance of the violation has been abated with 10 calendar days of the abatement date.
