Nevada Revised Statute 618.375(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer failed to ensure that employees maintained firm footing on the floor of a personnel platform and abstained from using railings to achieve additional reach or height while working from a personnel platform that was attached to a rough terrain forklift, as follows: a.At Crowne Professional Park at Stephanie construction site, 50 South Stephanie Street, Henderson, NV 89012, framing activities, two employees were exposed to a fall hazard as a result of not maintaining a firm footing on the floor of a personnel platform and using railings for the purpose of achieving additional reach or height while working at an elevation of approximately 20 to 25 feet without proper fall protection equipment/attire. Reference: ANSI/ITSDF B.56.6-2005 Safety Standard for Rough Terrain Forklift Trucks, Section 5.15, Paragraph 5.15.1, Subparagraph (u) Paragraph 5.15.1 Elevating Personnel, Subparagraph (u): personnel are to maintain firm footing on platform floor unless secured by body belt and lanyard. Use of railings, planks, ladders, etc., on the platform for purpose of achieving additional reach or height is prohibited; One feasible means of abatement would be to require employees to complete a refresher course in fall protection safety germane to the subject of scaffolding as it relates to personnel platforms that are attached to rough terrain forklifts for the purpose of elevating personnel.
